Warranty valid for any fuel tank, fuel system, headache racks purchased from Aluminum Tank & Tank Accessories, Inc (ATTA) on or after above effective date.
Certificate of Limited Warranty
Warranty is only valid with the return of warranty card to Aluminum Tank & Tank Accessories, Inc. within 30 days from the date of purchase by the original purchaser. The 7 year/Unlimited Mile warranty will not be valid without the return of the warranty card. The limited warranty is valid only for the vehicle listed on the warranty card. Valid only in the United States and Canada.
Seven Year/Unlimited Mile Warranty
Aluminum Fuel Tank Warranty:
Aluminum Tank & Tank Accessories Inc. (ATTA, Inc.) auxiliary diesel fuel tanks are covered by a 7 year/ Unlimited mile limited liability warranty, against defects in material and workmanship. Aluminum Tank & Tank Accessories, Inc. fuel system components are covered by a 7 year/ Unlimited mile limited warranty, except for the inline fuel pump and sending unit resistor. The inline fuel pump and sending unit resistor are covered by a 1 year limited warranty per manufacture requirements. ATTA generator tanks and other manufactured products are covered by a 1 year limited warranty.
Aluminum Headache Rack Warranty:
Aluminum Tank & Tank Accessories Inc. (ATTA, Inc.) aluminum contour headache racks are covered by a 7 year/Unlimited mile limited liability warranty, against defects in material and workmanship. The 6" oval LED lights are covered by a 1 year manufacture warranty. The 18" LED spot lights and the 52" LED Light bar, is covered by a 6 month manufacture warranty. Aluminum headache racks are not intended as a safety device.
Powdercoat/Spray-On Bedliner/Vehicle Paint Warranty:
Powdercoat, Spray-on Bedliner, and Vehicle Paint finish are covered by a 1 year limited warranty against defects.
Aluminum Tank & Tank Accessories, Inc. warranty begins when the original purchaser purchases the unit. The original purchaser is the person who will use for his own use. If a part must be replaced, ATTA, Inc. will furnish the replacement part on a "Return and Replace basis" only. ATTA will pay the established warranty labor rates, listed below, once authorization has been established. ATTA will make no payment for parts purchased or repaired in the field without prior written authorization from ATTA. We will not accept any charges greater than our established warranty rates. We reserve the right to examine the tank or part being claimed for warranty upon return to ATTA, with all shipping charges being prepaid to ATTA. If the warranty claim is determined valid, repair or replacement will be made at ATTA discretion. Warranty will not be honored if the tank or the component failure is caused by conditions beyond the control of ATTA such as damage caused by but not limited to:
- Customer's misuse or negligence
- Improper installation by the installer
- Shipment or improper handling
- Ordering of incorrect product
- Use of Contaminated fuels or improper fuel additives
- Road Debris
- Damage caused by fuel additives or contaminated fuels
Warranty Claim Procedure
If you have any problems with the fuel tank or fuel system, contact your Dealer where it was originally purchased. The Dealer will contact ATTA with any troubleshooting assistance. If a component needs to be replaced, ATTA will give a RGA (Return Goods Authorization) number, authorization and instructions for replacement of the component. ATTA will require Model and Serial number, proof of purchase, VIN#, and date of installation. When replacement item is shipped, a charge will be made for the part unless the part has been received by ATTA. Credit will be considered upon return of faulty item. All defective components must be returned within 30 days of warranty claim and be marked by the RGA number.
Certificate of Conformity
Aluminum Tank & Tank Accessories, Inc. fuel tanks and fuel systems conform to all rules pertaining to non-side mounted fuel tanks and meets all FHWA non-side mounted fuel tanks requirements as stated in sections 393.67.
AST Storage, LLC warrants to the original Purchaser only, that the bolted steel tanks manufactured by AST Storage, LLC shall be free from defects in material and workmanship for a period of 12 months from date of delivery without erection, or 12 months from date of substantial completion when AST Storage, LLC performs the erection. Should any defects arise during this warranty period, the defective parts will be replaced or repaired without charge to the purchaser at one of AST Storage, LLC facilities, or any other reasonable location (including the erection site) designated by AST Storage, LLC.
The warranty obligations of AST Storage, LLC shall be limited to repair or replacement of the defective parts and it shall not be liable or responsible under any circumstances or in any amount for consequential or incidental damages or for injury or damages to persons or property using or used in or in connection with the tanks, for loss of use or any other loss, cost or expense whatsoever. No person, firm, or corporation is authorized to make any representation or to incur any obligation in the name or on behalf of AST Storage, LLC except as stated herein.
This warranty applies only during normal use and care, and does not cover routine maintenance. This warranty is absolutely void if any tank is misused, neglected or damaged after delivery thereof to purchaser, or if any tank is improperly assembled or erected by someone other than AST Storage LLC, or if it has been repaired or altered by someone other than AST Storage LLC, or if it is not properly maintained.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. ANY ACTION OF THIS WARRANTY MUST BE COMMENCED WITHIN SIX MONTHS FROM THE DATE THE BREACH OF WARRANTY OCCURS OR SUCH ACTION SHALL BE FOREVER BARRED. THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF FITNESS AND/OR MERCHANTABILITY
Subject to other terms in this Limited Warranty, Manufacturer warrants to the original end user that Manufacturers' poly tanks will be free from material defects caused during the manufacturing process for a period of 5 years from the Purchase Date provided such warranty solely to the original end user shall be extended to 10 years from the Purchase Date if the original end user registers the Tank with Manufacturer within 30 days of the Purchase Date. To register the Limited Warranty, registration must be completed in accordance with the requirements set forth at enduraplaswarranty.com.
Limited Warranty for Non-Poly Tanks (including sprayers and refueling units):
Subject to other terms in this Limited Warranty, Manufacturer warrants to the original end user that that non-poly tanks, products and other parts manufactured by Manufacturer will be free from material defects caused during the manufacturing process for a period of 1 year from the Purchase Date unless otherwise expressly stated in writing by Manufacturer that an extended warranty applies. However, no warranty is provided with respect to the installation of outside components, unless previously authorized in writing by Manufacturer.
2. Other Warranties Disclaimed and Excluded:
THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WHICH EXTEND BEYOND THE LIMITED WARRANTY HEREIN STATED, AND MANUFACTURER EXPRESSLY DISCLAIMS AND EXCLUDES ANY AND ALL OTHER WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, INFRINGEMENT, CUSTOM OR USAGE OF TRADE, AND COURSE OF DEALING. NO AGENT, EMPLOYEE OR REPRESENTATIVE OF MANUFACTURER HAS AUTHORITY TO BIND MANUFACTURER TO ANY REPRESENTATION OR WARRANTY EXCEPT AS STATED IN THIS LIMITED WARRANTY.
3. Limitation of Liability under the Limited Warranty
In addition to those warranties disclaimed and excluded in clause 2 above, Manufacturer expressly further limits its warranty and liability under the Limited Warranty as set forth below in this clause.
3.1 The liability of Manufacturer under this Limited Warranty is excluded to the extent that any defect has been caused or contributed to by:
a) any accident, contamination, tampering, willful damage, abuse, modification, improper storage, improper use (including but without limitation the storage of material) or negligent act of, or omission by, any person other than Manufacturer;
b) failure to comply with Installation Instructions or any improper installation of the Goods, including deterioration of the base on which any of the Goods rest or are mounted to;
c) insufficient plumbing as described in Tank Installation Instructions;
d) any hindrance to the natural expansion and contraction of the tank;
e) any damage to the Goods caused by storm, freeze, wash away, landslide, mudslide, lightning, or any other natural phenomenon, vermin or other pests, and any undermining of the base of the Tank through any cause whatsoever;
f) the repositioning of the Goods from their original installation;
g) weathering or degradation of the Goods due to extreme climatic conditions;
h) failures surrounding extra fittings NOT installed by Manufacturer;
g) any staining or discoloration, including from trees or ash fall-out from fires or other causes;
h) a Tank not being placed on a base that is free of any protruding objects of any kind;
i) a Tank being used for any purpose other than the storage of suitable liquids at the ambient temperatures.
3.2 Without limiting the generality of clause 3.1:
a) Manufacturer will not be liable for any personal injury, property damage, shipping costs, indirect or incidental damages, consequential losses, loss of liquids, installation charges, loss of profit or any like claims whatsoever arising from any use of, or incidental to, or repairs to any of the Goods by a party other than Manufacturer;
b) to the extent that any component or material (including, but without limitation the polyethylene) used in the manufacture of any of the Goods is supplied and/or manufactured by a third party, the liability of Manufacturer is limited to Manufacturer's right of redress (if any) against the third-party supplier/manufacturer;
c) Tanks feature a vented lid at the time of manufacture. Any subsequent pressurization of the Tank by removing the vent, sealing the vent, or otherwise will cause this Limited Warranty as to such Tank to be null and void.
d) Manufacturer-produced outside tanks components (e.g., tank fittings, attachments accessorial parts) are covered by the Limited Warranty only if installed by or preauthorized in writing by Manufacturer.
3.3 The liability of Manufacturer under this Limited Warranty is limited to, at Manufacturer's discretion:
a) providing a comparable replacement Good FOB Manufacturer, any shipping or delivery charges are the responsibility of the person or entity filing the warranty claim;
b) providing a credit at an amount calculated on a pro-rated basis at a sum equal to the price paid by the original entity or end user divided by 60 months (5 year warranty) or 120 months (10 year warranty – IF the end user has registered and activated their extended warranty within 30 days of the original purchase date), multiplied by the number of months remaining in the warranty period; or
c) repairing the Good at no cost.
Manufacturer is NOT responsible for removal of the warrantied Good. In the instance that Manufacturer requires the warrantied Good be returned, said Good must be returned at Manufacturer's cost.
4. Claim Submission / Proof of Purchase:
To submit a Limited Warranty claim, contact Manufacturer at: customercare@enduraplas.com. Notification of warranty claims must be made within 14 days of product failure. The original invoice or other similar proof of purchase of the applicable product or part must be provided by original end user to Manufacturer when making a claim under this Limited Warranty. Warranty claims must be received in writing by Manufacturer within the Limited Warranty period. Additional documentation, including but not limited to pictures of the failure and installation, may be requested and is required to complete the warranty claim. 5. Nontransferable:
The Limited Warranty is given solely to the original end user and is nontransferable.
6. Definitions - For this Limited Warranty the following definitions apply:
a) Good(s) mean Tanks and/or other products, or parts manufactured by Enduraplas LLC.
b) Manufacturer means Enduraplas LLC.
c) Purchase Date means the date upon which the applicable goods were purchased by the original end user.
d) Purchase Price means the actual price paid for the Goods by the original end user purchaser.
e) Tank means the storage Tank manufactured by Manufacturer and purchased by the original end user Purchaser being the subject matter of this Limited Warranty.
7. State Law:
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusion may not apply to certain parties. Some states do not allow limitation on how long an implied warranty lasts, so the above limitation may not apply to certain parties. This Limited Warranty gives specific legal rights and other rights, which vary from state to state, may also apply.
8. Governing Law:
This Limited Warranty will be governed by the laws of the State of Minnesota, without giving effect to any choice of law rule that would cause the application of the laws of any other jurisdiction. Any disputes regarding matters relating to the Goods will be resolved exclusively in the State of Minnesota and all parties consent to such jurisdiction. RIGHTS TO A JURY TRIAL, CLASS ACTION AND CONSOLIDATED DISPUTE RESOLUTION PROCEEDINGS ARE WAIVED TO THE EXTENT PERMITTED BY LAW.
Quadel's standard warranty is one (1) year from the date of purchase to the original purchaser. Any part which proves defective as determined by Quadel personnel within the warranty period of 1 (one) year from the date of purchase will be repaired with a new or rebuilt part. In the event the product proves to be so defective that it precludes reasonable remedy the purchaser's sole remedy will be a refund of the purchase price. No responsibility shall be assumed by Quadel for removal, reinstallation, freight, labor or damages whether they be direct, indirect or incidental. Liability shall not apply to damage resulting from accident, tampering, alteration, design, inability to use, misuse, or abuse. If the product is altered in anyway from its original specifications the warranty is void.
Quadel's Titan Water Tanks adhere to the warranty guidelines listed above with the exception of the time frame which is extended from one (1) year to (3) three years.
PolyJohn Enterprises Corp. warrants the major plastic parts of its portable restrooms (plastic front, wall panels, roof, and tank) against any breakage or other problems that prevent the PolyJohn portable toilet from functioning in accordance with usual practices used in the portable toilet industry and in their intended manner. This warranty covers any damages in material or workmanship for a total period of 3 years (36 months). This warranty extends only to the original purchaser of the PolyJohn portable restroom. Proof of purchase, serial numbers, and photos will be required.
Coverage Period
Coverage under this warranty is for a total of 3 years (36 months) from time of manufacture. A part or repair supplied under this warranty will assume the balance of the original warranty period. During this time period if any major plastic parts covered by the warranty incur damage that prevent it from functioning, PolyJohn will provide replacement parts. Purchaser is responsible for any freight, labor, or other costs associated with replacement.
Filing Process for Warranty
PolyJohn reserves the right to request inspection of products for verification of defect, which may include returning some or all of the parts with shipping paid for by the purchaser. Once the items have been returned, inspected, and PolyJohn is found at fault shipping costs will be reimbursed.

What is Not Covered By Warranty
This warranty does not cover damage or failure contributed to or caused by: Not following PolyJohn assembly procedures, unauthorized modification, acts of God, mishandling, misuse, use of incompatible solvents or other damaging chemicals, vandalism or accident. In no event shall PolyJohn be liable for labor costs or for incidental or consequential damages.
**THIS WARRANTY IS IN LIEU OF ALL PRIOR WARRANTIES EXPRESSED OR IMPLIED**
POLYJOHN PORTABLE SINKS LIMITED PRODUCT WARRANTY
PolyJohn Enterprises warrants to the Purchaser that the Portable Sink sold to Purchaser is merchantable in quality and fit for the ordinary purpose for which it was intended, free from defects in material and in its manufacture for a period of one year (the "Warranty Period") from the date of purchase. Any misuse or abuse of the Portable Sink or component thereof* or failure to properly follow recommended procedures shall void this warranty. PolyJohn's responsibility with respect to their Portable Sinks or components thereof shall be limited to the foregoing.
1. In the event that the PolyJohn Portable Sink (1 year limited warranty) or component thereof (90 day limited warranty), proves defective in material or workmanship during the Warranty Period, claims regarding the Sink or component thereof shall be made by following the online submission form** stating the nature of the defect and that such claim occurred within the Warranty Period. On verification that the claim is valid, PolyJohn shall replace the Sink, or component thereof, found to be defective. Purchaser will be responsible for any shipping costs incurred.
2. PolyJohn shall in no case be liable for any damage to any property (other than the defect in the Sink, or component thereof, sold by PolyJohn), or for indirect, special, incidental or consequential loss or damage caused to Purchaser, or any customer thereof, even if PolyJohn has been advised of such loss or damage, whether in contract, tort or otherwise. No obligation exists to replace the PolyJohn Portable Sink, or component thereof, should there be evidence that the Sink or component thereof, was subject to improper use, acts of God, handling, storage or assembly by the Purchaser.
3. In the event of any valid warranty claim against PolyJohn, PolyJohn shall not be responsible to Purchaser and will not bear liability for damages, however caused, to persons or property or for the loss of anticipated profits or for any direct, indirect or consequential damages suffered by Purchaser, or any employee or property thereof.

The express warranties set forth above are in lieu of and supersede (i) all other warranties and remedies whether express or implied, oral or statutory, including any warranty of merchantability or fitness for a particular purpose, and (ii) any obligation. Liability, right, claim, or remedy in contract or tort, including without limitation product liability based upon strict liability and negligence. Neither party will be liable to the other for indirect, incidental, special, cover, consequential, or exemplary damages (including but not limited to loss of profits, revenue, or business) resulting from or in any way related to the goods or services purchased/sold hereunder, this order or termination of this order. This limitation applies regardless of whether the damages or other relief sought are based in contract or tort, including breach of contract including warranty, negligence, strict liability in tort, or any other legal or equitable theory.
2. Davey products are warranted to the original user only to be free of defects in material and workmanship for a period of 36 months from date of installation, but no more than 36 months from date of manufacture. Davey's liability under this warranty shall be limited to repairing or replacing at Davey's option, without charge, FOB Davey's distribution center or authorized service agent. Davey will not be liable for any costs of removal, installation, transport or any other charges that may arise in connection with the warranty claim.
3. This guarantee is subject to due compliance by the original purchaser with all directions and conditions set out in the Installation and Operating Instructions. Failure to comply with these Instructions, damage or breakdown caused by fair wear and tear, negligence, misuse, incorrect installation, inappropriate chemicals or additives in the water, inadequate protection against freezing, rain or other adverse weather conditions, corrosive or abrasive water, lightning or high voltage spikes or through unauthorized persons attempting repairs are not covered under guarantee. The product must only be connected to the voltage shown on the nameplate.
4. Davey shall not be liable for any loss of profits or any consequential, indirect or special loss, damage or injury of any kind whatsoever arising directly or indirectly from the product or any defect, and the purchaser shall indemnify Davey against any claim by any other person whatsoever in respect of any such loss, damage or injury.
5. Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. The warranty gives you specific legal rights and you may also have other rights which vary from state to state.
6. This guarantee applies to all states and territories of United States of America and Canada only.
Septic tanks and Underground Cisterns
Snyder Industries warrants the septic tanks and underground cistern tanks to be free of defects in material and workmanship for a period of three years from the date of manufacture; five years for the Dominator version. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply. Sole obligation under this warranty is as follows: Snyder Industries shall fulfill this warranty by repairing or exchanging any component part, F.O.B. Factory, that in Snyder Industries judgment shows evidence of defects, provided said component part has been paid for and is returned through an authorized dealer, transportation prepaid. The warrantee must also specify the nature of the defectto the manufacturer. The warranty does not cover treatment systemsthat have been flooded, by external means, or that have been disassembled by unauthorized persons, improperly installed, or subjected to external damage. This warranty applies only to the septic tank or cistern tank and does not include any of the residential wiring, plumbing, drainage, or disposal system. Snyder Industries is not responsible for any delay or damages caused by defective components or material, or loss incurred because of interruption of service, or for any other special or consequential damages or incidental expenses arising from the manufacture, sale, or use of this system. Snyder Industries reserves the right to revise, change, or modify the construction and design of the septic tank or cistern tank or any component part or parts thereof without incurring any obligation to make such changes for modifications in previously sold equipment. Snyder Industries also reserves the right, in making replacements of component parts under warranty, to furnish a component part which, in its judgment, is equivalentto the component part replaced. Under no circumstances will Snyder Industries be responsible to the warrantee for any other direct or consequential damages, including but not limited to lost profits, lost income, labor charges, delays in production, and/or idle production, which result from defects in material and/or workmanship of the septic tank. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
I. PRODUCT CATEGORIES
Supertanks, LLC, an Idaho limited liability company, dba Titan Fuel Tanks ("TITAN") sets forth herein its express warranty (this "Warranty") covering the following tank product categories (collectively, "Tank Products"):
A. Polymer body tanks that are specific to a particular vehicle and connect with the vehicle's fuel system, including (1) underbody tanks installed in place of the vehicle's original equipment tanks ("Underbody Tanks"), (2) Spare Tire Auxiliary Systems ("STAFS"), and (3) In-bed auxiliary Tanks ("Auxiliary Tanks")(collectively "Integrated Fuel Tanks");
B. Polymer body transfer tanks such as TITAN's 90 gallon,100 gallon, Trail Trekker, SideKick, UTV/Side by Side (“UTV”) fuel cells (“UTV Tanks”), and other liquid transfer tanks which are carried in a vehicle but not connected to the vehicle's fuel system ("Non-Integrated Fuel Tanks"); and
C. The polymer body TITAN Fuel Caddy designed for non-vehicular use ("Fuel Caddy Tanks").
II. STATEMENT OF LIMITED WARRANTY
Subject to the conditions and limitations of Paragraph III below:
A. Lifetime Warranty. TITAN warrants that the Tank Products set forth in Part I above, and the associated Kynar, nylon or metal fittings and metal strapping and mounting brackets, shall be free from structural failure due to corrosion and defects in workmanship and materials for as long as owned by the Original Purchaser as defined below.
B. Limited Warranty for Electronic Components. Electronic components (such as electronic controllers and associated printed circuit board, resistors, transistors electronic timers, level sensors and solenoid valves) on all Tank Products shall be free from defects in workmanship and materials for a period of six (6) months from the date of purchase.
C. Limited Life Products Warranty. Other components of the Tank Products, including without limitation all serviceable items, and other non-Tank Products (such as in-bed tool boxes, skid plates for UTVs, etc.) shall be free from defects in workmanship and materials for a period of one year from the date of purchase.
III. COVERAGE CONDITIONS, LIMITATIONS AND EXCLUSIONS
A. This warranty shall be in effect only in North America and Australia and is offered only to the original purchaser which has registered this Warranty and provided the information as set forth in Section V below (the "Original Purchaser"), and with respect only to Products purchased from TITAN or its authorized reseller.
B. This Limited Warranty does NOT cover:
1. A claim from any person or entity other than the original Purchaser;
2. A claim with respect to a vehicle specific tank installed in a vehicle other than the year, make, type and model of the vehicle for which the Product was designed by TITAN, or which has been reinstalled in another vehicle;
3. A Product that, in TITAN’s judgment, has been subjected to damage arising from external causes not consistent with normal and customary use of the Product, including without limitation:
(a) improper installation, removal, repair or alteration of the Product;
(b) natural disasters such as earthquake, fire, flood, or storm;
(c) damage to the Products caused by accident or collision involving the vehicle, or from repairs to the vehicle; or
(d) introduction of a fuel, fuel blend, liquid, or chemical into the Integrated Tanks, Non-Integrated Tanks, or Fuel Caddy Tanks other than as specified by TITAN.
C. Except for the above express warranty, TITAN MAKES NO OTHER WARRANTY RELATING TO THE PRODUCTS, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. In particular, TITAN shall not be liable for any consequential or incidental damages or claims alleged to have been caused by failure of the Products. In no event shall the Purchaser recover damages exceeding the amount of the purchase price of the Products.
D. Original Purchaser agrees that this Warranty shall be construed in accordance with the laws of the State of Idaho, USA, without reference to its choice of law principles. The state or federal courts located in Bonneville County, Idaho shall have exclusive jurisdiction to resolve any dispute relating to this Warranty.
IV. REMEDY FOR FAILURE OF WARRANTY
The Purchaser's remedy shall be limited to (a) repair of the Product, (b) replacement of the Product and related parts, or (c) refund of the Purchase Price of the Product, at TITAN’s sole option. The repaired or replaced Product shall be warranted for the remainder of the original Warranty Periods set forth above. Shipping costs, if any, shall be paid by the Purchaser.
V. HOW TO CLAIM THE WARRANTY
A. Within 60 days of purchase, provide proof of purchase of the Product and register the warranty with TITAN. You may do this online at www.titanfueltanks.com/warranty or by filling out and sending to TITAN the above Warranty Registration Form.
B. Send the Warranty Form and proof of purchase, together with an explanation of the problem with the Product, to TITAN by mail, fax or email addressed as follows:

C. TITAN will likely require an inspection of the Product by TITAN's field representatives or require you to take the Product to an authorized dealer or installer in your area. TITAN may also require photographs of the Product to be sent or emailed in order to evaluate warranty coverage.
D. As soon as possible after TITAN has received the requested materials, TITAN will notify the Original Purchaser whether the alleged defect is covered by this Warranty, and if covered, the remedy to be provided.
1. It is the reponsibility of the end user to perform initial cleaning, testing for leaks and the suitability of the storage tank to a specific application. Verify chemical compatibility in accordance with chemical resistant chart provided by resin manufacturer.
2. All external plumbing must have secondary support and must not apply excessive load on the tank outlets. Please provide flexible connections between tank and rigid plumbing installations. Lifting lugs are to be used only when tank is empty.
3. Refer to OSHA confined space entry procedures prior to cleaning any tank.
4. Warranty does not cover misuse, fire, accident, negligence, transit damage, unauthorized modifications to the product, excessive external pressure or abnormal use.
5. Warranty does not cover loss of product through leakage or damages for injuries persons or property caused by leakage.
6. Tanks and fittings have not been cleaned or pretested for leaks. Fill with water and clean before using. Rinse well and check compatibility before use.
7. Liability of the manufacturer under this warranty and any other warranty, expressed or implied, statutory or otherwise, is limited to repair or, at the Manufacturer's option, replacement of the defective product which is shown to have been defective when shipped, and only then if the Manufacturer is notified in writing of the defects within the warranty period and items in question are promptly delivered to it's point of manufacture. Transportation charges are to be prepaid.
8. Inspect product for any damages incurred during shipping and handling to tank and fittings upon receipt.
9. Vertical flat bottom tanks must be installed on a stationary, flat level, solid surface.
Rhino Tuff Tanks (RTT) stands behind all of our quality products and we will repair or replace at our discretion, any product found to be defective due to a manufacturing defect. The manufacturers warranty does not apply to any products that have been subjected to an accident, adjustment, improper installation, misapplication, misuse, modification, neglect, repair, including but not limited to improper maintenance, or use of unauthorized parts or attachments.
Provided that:
1. the Roth Eco DWT plus 3 is installed in accordance with the applicable installation instructions and specifications as published by ROTH.
2. the Roth Eco DWT plus 3 is used for its intended purpose, and in particular is used for storage of domestic heating fuel oil, diesel fuel for home heating ("Heating Fuel") and fluids included in Roth Technical Bulletin 117146-1 included in this document, in strict accordance with the Roth Eco DWT plus 3 manuals, instructions and specifications furnished by Roth,
ROTH WARRANTS THE PRODUCT AGAINST LEAKAGES CAUSED BY DEFECTS IN MATERIALS AND WORKMANSHIP FOR A PERIOD OF THIRTY (30) YEARS FROM THE WARRANTY START DATE SET FORTH BELOW (“Warranty Period”), SUBJECT TO ORDINARY WEAR AND TEAR AND NORMAL USE, AND SUBJECT TO THE TERMS OF THIS LIMITED WARRANTY.
This warranty applies solely and exclusively to a defect in materials or workmanship to the Product, and not to any defect in materials or workmanship of any other items, including but not limited to the fill, vent and/or return system (including the seals), multiple tank connections and other accessories and/or the improper handling, installation or filling of Heating Fuel into the Product. This warranty shall remain in effect for the original purchaser ("Purchaser") and subsequent transferees, but only while the tank remains at the site of original installation. Roth's sole and exclusive obligations, arising from, as a result of, or in connection with this Limited Warranty or the Product shall be limited to the following:
1. Product Repair or Replacement: Commencing on the warranty Start Date defined below for a period of thirty (30) years thereafter (the "Warranty Period"), Roth shall (i) at its discretion, either repair the Product or provide a replacement product (or 100% credit towards the purchase price of a replacement product) of similar size, design and quality, and
2. Labor Costs, Shipping, Insurance: Commencing on the warranty Start Date through the first ten (10) years of the Warranty Period, Roth shall pay all labor costs associated with such repair and/or replacement, all of which shall be at Roth's expense, up to a maximum of one thousand ($1,000) USD in each case. Purchaser shall be responsible for payment of the costs of shipping, freight and insurance on any replacement product, all of which shall be at Purchaser's expense.
3. Property Damage to Purchaser's Property: Commencing on the warranty Start Date through year ten (10) of the Warranty Period, Roth shall also reimburse Purchaser, up to a maximum amount of $2 million USD, for the costs and expenses incurred by Purchaser for damage to Purchaser's property directly and proximately caused by a leakage of liquids from a defective Product, including any and all On-Site environmental cleanup or remediation. On-Site cleanup or remediation means the taking of reasonable steps and the incurring of reasonable expenses for the response, abatement, investigation and removal actions required by law due to a leak on lands owned or controlled by the Product owner where the Product is located, but shall exclude any responsibility to remediate any contamination of adjoining lands or ground water and subject to the above limitations and exclusions. Roth Industries will directly perform the On-Site cleanup required to a reasonable standard and up to a maximum of $2 million (inclusive of all costs and expenses whatsoever).
EXCEPT AS SPECIFICALLY SET FORTH IN THIS LIMITED WARRANTY, ROTH HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS, IMPLIED AND STATUTORY, WITH RESPECT TO THE PRODUCT, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
The obligations of Roth under this Limited Warranty shall not apply in the event that the Product (i) has been installed, assembled or repaired by anyone other than Roth or an authorized Roth installer, representative or dealer; (ii) has been altered in any manner whatsoever; (iii) has been subject to misuse, neglect, abuse, improper storage, alteration, improper or insufficient maintenance, unauthorized repairs, an accident or accidents, fire, flood, earthquake other casualty or acts of God, act of war, or hostile disturbance; (iv) has had its serial number altered, effaced or removed; (v) has been assembled or installed other than in accordance with the Product instructions and specifications furnished by Roth; (vi) has been used for a function or application other than that for which it was designed, i.e., solely as a storage tank for Heating Fuel; or (vii) has been subjected to improper handling, filling or overfilling of the Product.
Warranty Start Date; Warranty Period; Additional Conditions:
1. The Product warranty period shall start from the date of installation, on condition that the Product is installed within twelve (12) months of the date of manufacture of the Product and the date of installation can be reasonably ascertained by Roth. If the Product was installed more than twelve (12) months after the date of its manufacture, or if the date of installation cannot be reasonably ascertained, Roth may determine, in its reasonable discretion, that the Warranty Period begins as of the date of manufacture of the Product ("Start Date").
2. The Warranty Period shall be for thirty (30) years after the Start Date ("Warranty Period").
3. THIS LIMITED WARRANTY SHALL BE VOID IF THE PRODUCT IS MOVED FROM THE PLACE OF ORIGINAL INSTALLATION OR IF THE PLACE OF ORIGINAL INSTALLATION CANNOT BE ASCERTAINED IN THE REASONABLE DISCRETION OF ROTH.
4. The installation, assembly and use of component parts in connection with the Product from sources other than Roth or its authorized installers, representatives or dealers shall void the obligations of Roth under this Limited Warranty. Roth expressly disclaims any liability arising out of any combination of the Product with the products of third-parties.
Limitation of Liability
Roth's sole and exclusive liability for any claim arising from, as a result of, or in connection with this Limited Warranty or the Product shall be limited exclusively to the terms of this Limited Warranty, whether such claim is based on breach of warranty, tort, negligence, strict liability, product liability or otherwise. ROTH, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES, SHALL IN NO EVENT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM, AS A RESULT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY OR THE PRODUCT.
No cause of action, regardless of form, arising from or in any manner connected with this Limited Warranty or the Product may be brought against Roth more than one (1) year after the date such cause of action accrued.
This is a Limited Warranty which gives you specific legal rights, and you may have other rights which vary from state to state or province to province. This Limited Warranty is valid only for tanks installed in the United States and Canada on or after January 1, 2012. This Limited Warranty is governed by the laws of the State of Delaware.
Warranty Claim
1. In the event of an alleged defect in the Product, please call customer assistance immediately without delay at Ph: 888-266-7684 to obtain a Service Order Number, and to arrange for an inspection of the Product by Roth or its authorized installer, representative or dealer.
2. Purchaser must also notify Roth in writing at the address below of the leakage caused by a defect in materials or workmanship within ten (10) days after the leakage is discovered or reasonably should have been discovered, known hereafter as "Purchaser's Notice".
THE FAILURE TO TIMELY NOTIFY ROTH INDUSTRIES OF A WARRANTY CLAIM AS SET FORTH ABOVE SHALL VOID THIS LIMITED WARRANTY.
The following information must be completed by Purchaser within thirty (30) days of the date of installation and mailed to Roth Industries at the address shown below. THE FAILURE TO SUBMIT THIS INFORMATION SHALL VOID THIS LIMITED WARRANTY.
1. The Limited Warranty extends to the original purchaser only and is not transferable by operation of law or otherwise.
2. The Limited Warranty is limited to the repair or replacement of the tank, at the sole discretion of Seller. Seller is not liable for any damage to property or any other associated costs that may occur when repair or replacement of the tank is carried out. Repair work is undertaken at ground level, so tanks that are located on stands must be brought down to ground level before Seller can commence repair work.
Note that expenses such as landscaping, plumbing, electrical, costs of lifting equipment and hire of additional labor are at purchaser's expense. Bringing tanks down from stands for repair work is also at the purchaser's expense.
3. The Limited Warranty does not apply to the tank color, which may in time fade or change.
4. The Limited Warranty applies to the one piece polyethylene structure of the tank and does not extend to fittings such as the strainer, outlet, valve, tap, overflow or any other fittings, accessories or ancillary components. Some fittings, accessories and ancillary components are covered under a separate limited warranty program, which is available upon request.
5. The Limited Warranty on water tanks is for the storage of water only, at a water temperature not exceeding 73F/23C. The Limited Warranty does not apply to tank damage due to freezing.
6. The Limited Warranty on water tanks is for storage of water on the site only. Transporting water in water tanks voids the Limited Warranty.
7. The Limited Warranty is void and will not be binding upon Seller in the event of damage to unsecured tanks through blowing away, or by abuse, improper installation, unsound base, or unauthorized modifications to the tank.
Note that all installation instructions must be followed and in particular the fitting of flexible hoses.
8. Seller must be notified of any defect or fault (using a Seller-approved claim form) within seven (7) days of it occurring. Seller must be given the opportunity to inspect the tank within thirty (30) days of such notification, otherwise the Limited Warranty is void.
9. THIS LIMITED WARRANTY IS THE EXCLUSIVE WARRANTY PROVIDED BY SELLER AND IS IN LIEU OF, AND SELLER DISCLAIMS, ALL OTHER WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, WITHOUT LIMITATION, (I) ANY IMPLIED WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE, (II) ANY IMPLIED WARRANTY ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE, (III) ANY OTHER OBLIGATIONS OR LIABILITIES WHATSOEVER, WHETHER IN CONTRACT, WARRANTY OR TORT, OR BY STATUTE OR OTHERWISE FOR ANY NONCONFORMANCE, DEFECT, DEFICIENCY, FAILURE, MALFUNCTION OR FAILURE TO PERFORM, (IV) STRICT LIABILITY OR PRODUCT LIABILITY, AND (V) ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL AND INCIDENTAL DAMAGES OF ANY NATURE WHATSOEVER.
This warranty will not apply to defects or malfunctions resulting from, but not limited to, failure to properly install, secure, use, or failures from abuse, accident, or negligence. Tank Holding shall not be held responsible for any loss or damage to personal property in, or next to, the failed unit, or any other consequential damage to the extent such damages are excluded under state law. No responsibility is assumed for loss of use of the product or the inconvenience caused thereof.
ANY IMPLIED WARRANTIES OF MERCHANTABILITY SHALL BE LIMITED TO THE WARRANTY PERIOD OUTLINED ABOVE. THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. TANK HOLDING SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER IN CONTRACT, TORT OR OTHERWISE.
A notice of failure must be made to the custom molding division that produced the product in a timely manner before any warranty coverage will be authorized.
Products manufactured by Walrus Pumps Co (Walrus) are warranted to the first user only to be free of defects in material and workmanship for a period of 12 months from date of installation, but no more than 24 months from date of shipment. Walrus' liability under this warranty shall be limited to repairing or replacing at our election, without charge, FOB Walrus' distribution center or authorized service agent. Walrus will not be liable for any cost of removal, installation, transportation or any other charges that may arise in connection with warranty claim. The warranty period commences on the date of original purchase of the equipment. Proof of purchase and installation date, failure date, and supporting installation data must be provided when claiming repairs under warranty. This warranty is subject to due compliance by the original purchaser with all directions and conditions set out in the installation and operating instructions. Failure to comply with these instructions, damage or breakdown caused by fair wear and tear, negligence, misuse, incorrect installation, inappropriate chemicals or additives in the water, inadequate protection against freezing, rain or other adverse weather conditions, corrosive or abrasive water, lightning or high voltage spikes or through unauthorized persons attempting repairs are not covered under warranty. Walrus will not be liable for any incidental or consequential damages, losses, or expenses, arising from installation, use, or any other causes. There are no express or implied warranties, including merchantability or fitness for a particular purpose, which extend beyond those warranties described or referred to above. Certain states do not permit the exclusion or limitation of incidental or consequential damages or the placing of limitations on the duration of an implied warranty, therefore, the limitations or exclusions herein may not apply. This warranty sets forth specific legal rights and obligations, however, additional rights may exist, which may vary from state to state.
Fill-Rite LIMITED WARRANTY POLICY
If you tank was NOT INSTALLED by Pinnacle Water Tanks, Pinnacle warrants each new water tank manufactured to be free from defects in material or workmanship for ONE YEAR from the date of initial by original purchaser. If such a defect is found by the Pinnacle Water Tanks to exist within the one year period, the Pinnacle Water Tanks will, at its option, (a) repair or replace such product free of charge, F.O.B. the factory of manufacture, or (b) refund to the original purchaser the original purchase price, in lieu of such repair or replacement. The duration of the warranty will run from the date of purchase from a dealer or distributor authorized by Pinnacle Water Tanks (the “warranty period”).
EXCLUSIVE REMEDY-REPLACEMENT:
Within the warranty period, Pinnacle Water Tanks will replace the goods and/or original manufactured components thereof which are found, to manufacturer satisfaction, to be defective. Pinnacle Water Tanks is not responsible for direct, indirect, special, consequential, or any other damages of any kind, including personal injury to any individual, howsoever caused, including caused by transportation of the goods for repair or replacement.
PROCEDURE FOR OBTAINING SERVICE:
In event of a warranty claim, the purchaser must complete any and all information required by Pinnacle Water Tanks in order to properly assess or investigate the claim. Pinnacle Water Tanks will not be responsible for the removal of any goods found to be defective, or transportation charges to and from Pinnacle Water Tank authorized distributor or dealer, or for installation of any replacement goods and/or parts furnished under the warranty.
LIMITATION OF IMPLIED WARRANTIES AND OTHER REMEDIES:
To the extent allowed by law, neither Pinnacle Water Tanks nor its dealers, nor any company affiliated with Pinnacle Water Tanks makes any implied or other warranties, representations, or promises as to the quality, performance, or freedom from defect of any product covered by this warranty.
PINNACLE WATER TANKS HEREBY DISCMAIMS, TO THE EXTENT APPLICABLE, ANY AND ALL IMPLIED WARRANTIES OF MERCHANT ABILITY AND FIRNESS FOR A PARTICULAR PURPOSE. PURCHASERS ONLY REMEDIES IN CONNECTION WITH THE WARRANTY ARE THOSE SET FORTH IN THIS WARRANTY. IN NO EVENT, WILL PINNACLE WATER TANKS, OR ITS DEALERS, OR ANY COMPANY AFFILIATED WITH PINNACLE WATER TANK BE LIABLE FOR INCIDENT, CONSEQUENTIAL OR PUNITIVE DAMAGES. Some jurisdictions do not allow waivers of certain warranties, so the above waivers may not apply to you. In the event, any implied warranties are limited in duration to ninety (90) days from delivery of the products. You may also have other rights which vary from jurisdiction to jurisdiction.
LIMITATION AS TO THE SCOPE OF THE WARRANTY:
The warranty does not extend to defects or damage caused, in whole, or in part, by:
1. Use of a kind and/or to degree not reasonable to be made of the goods;
2. Improper storage of the goods both prior to and after purchase;
3. Damage caused by, or in the course of installation or assembly;
4. Any use of good of which is not an intended use as specified in manufacturer published product literature, or otherwise specified by manufacturer in writing;
5. Any equipment attached to or used in conjunction with the goods that is not Pinnacle Water Tanks product nor supplied by Pinnacle Water Tanks;
6. Any field modifications, or substitutions, to the original water tank system components;
7. Acidic environmental condition affecting the structural strength or integrity of the goods;
8. Any other circumstances not in keeping with proper maintenance and/or use of the goods;
9. Acts of god, accidents, abuse or neglect of the goods by the purchaser and/or any other individual or entity;
10. Cosmetic changes such as white rust and scratches.
EXCLUSIVE WARRANTY:
This warrant is the only warranty provided by Pinnacle Water Tanks and all other warranties and/or commitments whether expressed or implied and no matter by whom made, statutory or otherwise, are subsumed and replaced by it and are of no legal effects. If any of warranty is held by a court of competent jurisdiction to be void or unenforceable, in whole or in part, such provisions shall be deemed severable and will not affect or impair the legal validity of any other provision of the warranty.
Failure to comply with the points below voids warranty.
A. Tanks are not fire-resistant. Do not store them near an open flame or heat in excess of 180 F.
B. Do not install any tank under the path of vehicles or heavy equipment.
C. Do not leave Low Profile septic tanks empty for extended periods of time.
D. Low Profile septic tanks and cisterns are designed only for use as underground tanks.
E. Low Profile septic tanks and Low Profile cisterns may be used as holding tanks or for pumping applications where permitted by local codes.
F. Low Profile natural colored cisterns are made of resins that meet FDA specifications for the storage of drinking water and can be used for that application.
G. Protect the tank from sharp objects which could puncture it and cause leakage.
H. Where saturated soil or seasonal high water tables are indicated between the bottom of the tank and the ground surface, see separate Supplemental Installation Instructions on our website.
I. For installations requiring counter-buoyancy measures; please refer to Counter-Buoyancy Instruction on our website.
J. Maximum temperature of liquid entering tank is 120 F.
K. Maximum bulkhead fitting size is 4". It is not advised to use this plastic underground tank for any application other than typical household sewage. Such uses would void product warranty.
WARRANTY
Manufacturer warrants that if this part is proven to be defective in material or workmanship within three (3) years from the date of manufacture, manufacturer will (at company's option) either replace or repair said part. This standard limited warranty does not apply to damages resulting from misuse, improper application of recommended materials, accident, or improper installation or maintenance. Remedy to the buyer is limited to the replacement of any defective product (or its component where applicable), F.O.B. point of manufacture. The buyer's remedy under this warranty does not include any other direct or indirect consequential damages which result from defects in material and/or workmanship of its products.
TANK(S) IN THIS AGREEMENT ARE DESIGNED FOR ATMOSPHERIC PRESSURE. PROPER VENTING REQUIRED. NOT DESIGNED FOR OVER THE ROAD USE. BUYER ASSUMES ALL LIABILITY FOR ALTERNATIONS, ADDITIONS OR MODIFICATION IT REQUIRES NEWBERRY TO MAKE TO INDUSTRY STANDARD DESIGNS AND PRODUCTS.
Sotera LIMITED WARRANTY POLICY
Warranty will not apply when product failure is caused by conditions beyond the control of Transfer Flow, such as:
- Malfunction due to incorrectly ordered product
- Damage from misuse, negligence, or failure to provide reasonable and necessary maintenance
- Damage caused by improper installation
- Damaged caused in shipment or improper handling
- Damage caused by contaminated fuels or fuel additives
- Product modification or alteration
- Products made from pickled and oil material are not covered under warranty for corrosion
Any action against Transfer Flow for breach of the warranty must be commenced in the Superior Court of Butte County, State of California.

Certificate Of Limited Warranty
1. Six Year/Unlimited Mile Warranty
TRANSFER FLOW, INC. (“TFI”) fuel systems and parts are - EXCEPT AS NOTED IN PARAGRAPHS 2, 3, AND 4 BELOW - covered by a six year unlimited mile warranty against defects in material and workmanship. This warranty is in effect in the United States and Canada from the date the unit is purchased by the Original Purchaser ("Original Purchaser" shall mean the person who purchases for his own use).
2. Specific Parts Warranty
Specific parts purchased from TFI are warranted against defects in material and workmanship as follows:
- Sending units are covered by a two year warranty from the date of purchase by the Original Purchaser for the Original Vehicle.
- 12-volt refueling pumps are covered by a two year warranty from the date of purchase by the Original Purchaser for the Original Vehicle (AND ARE NOT TO BE USED FOR AVIATION FUEL).
- 6 PSI pumps are covered by a two year warranty from the date of purchase by the Original Purchaser for the Original Vehicle.
- Fuel gauges are covered by a two year warranty from the date of purchase by the Original Purchaser for the Original Vehicle.
THE TFI WARRANTY, DESCRIBED IN PARAGRAPHS 1 AND 2 ABOVE, IS SUBJECT TO THE FOLLOWING EXCLUSIONS AND LIMITATIONS:
- The rights of the Original Purchaser under the TFI warranty are LIMITED to return of the goods and repair or replacement of nonconforming goods.
- THIS WARRANTY DOES NOT COVER INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO: LOSS OF USE OF THE WARRANTED PRODUCT, LOSS OF TIME, INCONVENIENCE, TRANSPORTATION EXPENSES, TOWING, EXPENSES FOR TRAVEL, LODGING, TELEPHONE AND GASOLINE, LOSS OR DAMAGE TO PERSONAL PROPERTY OR LOSS OF REVENUE. NOTE: SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
- Warranties will only cover products on which the identification label is affixed; if the label has been removed or defaced, the warranty is no longer valid.
- TFI fuel systems are compatible with a maximum 20% concentration of biodiesel fuel manufactured ASTM D7467 specifications. Concentrations above 20% or failing to comply with ASTM D7467 specifications will void warranty.
- THE WARRANTY PROVIDED IN PARAGRAPHS 1 AND 2 ABOVE IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES (EXPRESS, IMPLIED, OR OTHERWISE) INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT IMPLIED WARRANTIES MAY NOT BE EXCLUDED, THE TERM OF ANY IMPLIED WARRANTY SHALL NOT EXCEED THE TERM OF THE APPLICABLE EXPRESS WARRANTY PROVIDED IN PARAGRAPHS 1 AND 2 ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
- The warranty will not apply when product failure is caused by conditions beyond the control of TFI, such as:
- Malfunction due to incorrectly ordered product
- Damage from misuse, negligence, or failure to provide reasonable and necessary maintenance
- Damage caused by improper installation or not following installation instructions.
- Damaged caused in shipment or improper handling
- Damage caused by contaminated fuels or fuel additives
- Product modification or alteration
- Products made from pickled and oil material are not covered under warranty for corrosion.
- The in-line fuel filter provided with the TFI fuel system is not covered by warranty as it is a standard maintenance item.
- Any action against TFI for breach of the warranty must be commenced within one (1) year after the cause of action has accrued.
- Any action against TFI for breach of the warranty must be commenced in the Superior Court of Butte County, State of California.
- If you have difficulty with your fuel system, consult the dealer where the unit was originally purchased. Your dealer will then contact TFI and request assistance. TFI will require model, part and serial numbers, proof of purchase, and date of installation. TFI reserves the right to examine the claimed defect in the field or upon return of the tank or component to TFI’s facility with all shipping charges being prepaid. If a part is defective and must be replaced, TFI will provide a Returned Merchandise Authorization (“RMA”) number, authorization, and instructions for replacement or further handling.
- No payment will be made for parts purchased or repaired in the field without prior authorization by TFI.
- TFI will pay its established warranty labor rates to service points or service dealers who have service agreements with TFI.
- If an item is shipped as a replacement for a defective part, a charge will be made for this part. Credit will be considered upon return of the defective item. ALL RETURNED ITEMS MUST BE IDENTIFIED WITH THE RMA NUMBER AND RETURNED WITHIN 30 DAYS OF OPENING THE CLAIM.
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State, and in accordance with specific federal regulations. TFI does not authorize any person to create for TFI any other obligation or liability in connection with TFI fuel systems. If TFI fails to successfully perform its obligation under this warranty, the Original Purchaser has available the remedies provided by the Magnuson-Moss Warranty Act (P.L. 93-637) and any applicable state law.
What Does This Warranty Cover?
WaterPrepared warrants the Product against defects in material and workmanship only as follows:
WaterPrepared will replace at no charge for parts only or, at its option, replace any Product or part of the Product that proves defective because of improper workmanship and/or material, under normal installation, use, service and maintenance. If WaterPrepared is unable to provide a replacement and repair is not practical or cannot be made in a timely fashion, WaterPrepared may elect to refund the purchase price in exchange for the return of the Product.
How Long Does the Coverage Last?
Should a Product be found defective within one year of delivery, WaterPrepared will replace the Product (or the defective part) with a water tank of equal value.
What Does This Warranty Not Cover?
Conditions, malfunctions or damage not resulting from defects in workmanship or material;
Conditions, malfunctions or damage resulting from normal wear and tear, improper installation, improper maintenance, misuse, abuse, negligence, accident or alteration;
Accessories, connected materials and products, or related products not manufactured by WaterPrepared; and
Although stripped fittings as a result of improper installation are not covered under warranty, they may be replaced at the discretion of WaterPrepared.
What is the Period of Coverage?
WaterPrepared, LLC, (hereinafter, "WaterPrepared") provides a one year product warranty on all 160 gallon water tanks (the "Product").
What Will We Do to Correct Problems?
If a Product is believed to be defective, you must contact WaterPrepared immediately. WaterPrepared reserves the right to question proper installation and request pictures of the defect if necessary. If adequate documentation of the defect cannot be provided, you will be responsible for the cost of replacement until WaterPrepared can verify that a defect is found. WaterPrepared reserves the right to fix any defect at the place of installation prior to providing a replacement.
How Do You Get Service?
WaterPrepared will not provide any warranty coverage unless claims are made in compliance with the following terms and conditions and you follow proper return procedures:
The request must be submitted in writing within 30 days of discovery of the possible defect (mailed certified return receipt-return receipt requested, postage prepaid);
To request warranty service, you must provide: the sales receipt or other evidence of the date and place of purchase and the identity of the party who sold the Product to you;
A description of the problem;
WaterPrepared reserves the right of inspection to determine validity of your claim of defective Product under the terms of this Limited Warranty. WaterPrepared further reserves the right to approve and negotiate the terms of repair or replacement.
What Must You Do to Keep the Warranty in Effect?
The commitment of WaterPrepared hereunder and the agreement of WaterPrepared to provide the limited warranty described herein are subject to the satisfaction of each of the following conditions precedent in a manner acceptable to WaterPrepared in its sole and absolute discretion:
How Does State Law Relate to This Warranty?
This Limited Warranty constitutes the complete, final, exclusive, and fully integrated statement of warranty between you and WaterPrepared concerning the Product. Any action brought relating to this Limited Warranty shall be instituted and litigated in the courts of the State of Utah located in Utah County, Utah, or the Federal courts for the District of Utah in Salt Lake City, Utah. This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Utah.
What are the limits on this warranty?
This warranty is limited to the Product itself and does not include accessories, delivery, installation, or removal of the Product.
This warranty shall be void to the extent of (i) any modification of a Product by any person or entity other than WaterPrepared, (ii) misuse or abuse of a Product unless such misuse or abuse is perpetrated by WaterPrepared or its agents, (iii) negligence or wrongdoing unless such negligence or wrongdoing is perpetrated by WaterPrepared or its agents, (iv) accident, disaster or event of force majeure, (v) use of a Product in any manner inconsistent with its intended use as a water storage product, (vi) improper storage of a Product, (vii) use of a Product in combination with products, equipment or software not supplied by WaterPrepared or (viii) use of a Product in combination with products supplied by others without the technical approval of WaterPrepared.
This Limited Warranty shall be invalid if the buyer fails to comply with every term and condition of the Limited Warranty.
LIMITED LIABILITY
WaterPrepared is in the business of selling stackable water tanks. WaterPrepared may suggest emergency preparedness practices based on common practices, experience, third party research from organizations such as FEMA and other emergency preparedness groups, and other non-professional sources. Suggested practices may or may not be suggested based on quantitative research and should be considered only as examples of optional practices. WaterPrepared will not be held liable for any damages resulting from the implementation of any practices suggested on the website or by WaterPrepared representatives.
THIS LIMITED WARRANTY CONSITUTES THE ONLY WARRANTY MADE BY WATERPREPARED CONCERNING THE PRODUCT AND IT HEREBY EXCLUDES ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
UNDER NO CIRCUMSTANCES SHALL WATERPREPARED BE LIABLE TO YOU OR ANY USER FOR CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LABOR AND ANALYSIS FEES), WHETHER FORESEEABLE OR UNFORESEEABLE, BASED ON ANY CLAIM OF ANY OTHER PARTY ARISING OUT OF BREACH OR FAILURE OF EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, MISREPRESENTATION, NEGLIGENCE, STRICT LIABILITY IN TORT, FAILURE OF ANY REMEDY TO ACHIEVE ITS ESSENTIAL PURPOSE, OR OTHERWISE. NOTWITHSTANDING THE FORM (E.G., CONTRACT, TORT OR OTHERWISE) IN WHICH ANY LEGAL OR EQUITABLE ACTION MAY BE BROUGHT, IN NO EVENT WILL WATERPREPARED BE LIABLE FOR DAMAGES OR LOSSES THAT EXCEED, IN THE AGGREGATE, THE AMOUNT PAID BY BUYER FOR THE PRODUCT.
MISCELLANEOUS
Custom orders (specials), used Product, incomplete Product (Product missing parts and/or a portion of original quantity; Product with damaged or missing labeling), Product not purchased from WaterPrepared, expired lot or shelf-life Product, Product not returned prior to 90 days after invoice, and certain resale items are non-returnable.
For California residents only: California law also provides that for any Warranty Service for a Product, California residents have the option of returning the Product (a) to the retailer from which it was originally purchased, or (b) to another retailer that sells the same Product, among other rights and consumer protections. California residents need only supply their proof of purchaser, in each case above or to WaterPrepared, for warranty service and should call WaterPrepared for specific instructions. WaterPrepared will only be responsible for the cost of the repair, replacement and shipping and handling for the defective Product. A retail store to which a California resident returns a Product for warranty service may then repair the Product, refer the you to an independent repair facility, replace the Product or refund the purchase price of the Product less the amount directly attributed to your usage of the Product. If the above options do not result in the appropriate remedy to you, you may then take the Product to an independent repair facility if service or repair can be economically accomplished. WaterPrepared and not you will be responsible for the reasonable cost of such service, repair, replacement or refund for the non-conforming Product during the warranty period.
1. What's covered
1.1 Subject to the terms of this Policy, Western Global warrants that the goods sold by Western Global (the "Goods") will correspond with their specification at the time of delivery and will be free from material defects in material and workmanship for the following periods (the "Warranty"):
(a) in the case of Steel Tanks (being Western Global steel storage tanks manufactured for the storage and transportation (if applicable) of fuel and/or other industrial liquids), 8 years from the date of delivery; and
(b) in the case of all other products, parts and accessories, 1 year from the date of delivery.
1.2 Any replacement and/or exchange parts provided by Western Global or repairs undertaken by Western Global to the Goods (or any part thereof) will be warranted for the remainder of the original warranty or for a period of ninety (90) days, whichever is greater.
2. What's not covered
2.1 The following will NOT be covered by the Warranty:
(a) costs of normal maintenance;
(b) defects arising from neglect, misuse or unauthorised modifications;
(c) damage caused by abuse, misuse, dropping or other similar damage caused by or as a result off a failure to follow transportation, storage, loading or operation instructions;
(d) damage caused by user negligence;
(e) lack of proper maintenance of the Goods including, without limitation, lack of lubrication, protection and/or maintenance under the supervision of suitably qualified persons;
(f) alterations, additions or repairs carried out by persons other than Western Global personnel;
(g) transportation or shipment costs to and from Western Global, for repair or assessment against a warranty claim, on any Goods (or part thereof);
(h) any consumable items (including (but not limited to) fluids, filters, fuses, bulbs and/or any other consumable item or normal wearing item);
(i) materials and/or labour costs to renew, repair or replace components due to fair wear and tear; and
(j) faults arising from the use of non‐standard or additional parts, or any consequential damage or wear caused by the fitting or use of such parts.
3. Making a warranty claim
3.1 All claims must be made within thirty (30) days from the date on which the buyer becomes aware or should have become aware of any damage or defect with the Goods. If Western Global do not receive notice of a warranty claim within the above timeframe then Western Global will have no obligations under the warranty in respect of that issue.
3.2 If you need to make a warranty claim please download and complete the Warranty Application which can be found at https://western-global.com/warranty/. Once complete the Warranty Application (along with proof of purchase) should be sent to your Western Global sales representative or e-mail info@western-global.com.
3.3 Following receipt of a valid and accepted Warranty Application, Western Global will use its reasonable endeavours to inspect and/or repair and/or replace and/or refund the relevant Goods (or part thereof) within a reasonable time period. Unless agreed by Western Global in writing, if you arrange for a third party to carry out any repairs or work on the Goods (or part thereof) then Western Global will have no liability under the Warranty.

4. Other terms
4.1 The benefit of this Warranty shall be exclusively for the buyer and shall not be in any way be relied upon by any third parties.
4.2 The Warranty is the only Warranty given by Western Global in relation to the Goods. All other warranties (express or implied) are excluded to the maximum extent permitted by law.
4.3 Western Global shall not (in any circumstances) be liable whether in contract, tort or other legal theory, for any loss of profit, loss of goodwill, loss of business, loss of business opportunity, loss of anticipated saving, loss or corruption of data or information and/or any special, indirect or consequential damage suffered by the buyer.
4.4 If a warranty claim is accepted, Western Global may choose to repair, replace or refund the Goods (or any part thereof) at its sole discretion.
