I. Color Disclaimer

All pictures, colors and stains viewable on this website may appear slightly different based on many different computer and monitor factors. Some colors may appear slightly darker (or lighter) on one computer versus another.

When placing and completing an order through TankAndBarrel.com, you acknowledge and accept this fact, and waive any claim of dissatisfaction due to color, texture and stain.

II. Return / Cancellation Disclaimer

Returns - Return information is located on our Shipping and Returns page and is different per manufacturer. Please read this information carefully. Most products can be returned minus a restocking fee (varies per manufacturer) and freight charges both ways.

Cancellations - Due to the fact that most items are custom made, if an item has entered production, cancellations will NOT be honored.

III. Shipping Disclaimer

The manufacturer(s) will ship your product(s) directly to your residential or commercial delivery address.

Shipping times will vary depending on the item selected. Average shipping times vary between 2 days to 6 weeks depending on the product and the manufacturer.

TankAndBarrel.com can NOT guarantee specific delivery dates and/or time in transit.

Manufacturers ship via UPS Ground, FedEx Ground or LTL truck direct. Expedited shipping may be available if you decide to pay the additional shipping costs. Please contact us for more information on expedited shipping quotes.

For all the shipments that are too large (or too heavy) for FedEx and UPS, a custom LTL freight company will be used. Keep in mind that most custom freight companies are NOT REQUIRED to carry your products off of the truck. This is why large items may require liftgate service. Please see our Shipping and Returns page for more information.

Please double check the accuracy of your shipping address prior to checking out, as incorrect addresses that have to be changed after your item has shipped will incur a $25.00 rescheduling fee!

Most tracking numbers are provided automatically. However, if you do not receive one, please contact us.

In the unlikely event that a product is lost, damaged or missing, PLEASE perform the following steps! This is critical for TankAndBarrel.com to help you! If the following steps are not performed within 24 hours, we CANNOT help you. We must make this clear. These instructions are per the manufacturers rules and regulations concerning lost, damaged or missing items.

NEVER try to send your product back to the manufacturer WITHOUT explicit instructions from TankAndBarrel.com Only authorized returns, with Return Authorization numbers are accepted. No exceptions. Always keep all packaging materials and boxes in case they need to be inspected by the shipper, or used to return your product.

Part 1. If your product is damaged at time of delivery:

a) INSPECT your products / boxes upon delivery. OPEN all packages and verify there is no damage. If you feel an item is damaged, REFUSE THE SHIPMENT AND WRITE "DAMAGED" ON THE DELIVERY RECEIPT. Signing your name on the delivery receipt and accepting the delivery will alleviate the freight carrier of all claims. Please note that slight scuffs and dirt on your product is NOT considered damage as this may occur as normal wear and tear during packaging and transit.

b) "TankAndBarrel.com" MUST be contacted within 24 hours of delivery for us to file a claim through the manufacturer for you.

Please include the following information in your email:
- Your contact information (Name, Address, Phone number, Order number)
- Briefly describe what is damaged
- Photos of the damage
- Tracking number

c) Wait for a response or phone call from TankAndBarrel.com and we will provide you with further instructions.

Part 2. If you discover your item is damaged after the shipper has left your residence:

In the event that after you open the boxes you discover that an item has been damaged, please perform the following steps within the first 24 hours!! :

a) TankAndBarrel.com MUST be contacted within 24 hours of delivery for us to determine if anything can be done. If you have already signed the delivery ticket that the package arrived in good condition, unfortunately most claims will be refused. We cannot stress enough how important it is to inspect all packages at the time of delivery. You can email us anytime from our contact us page.

Please include the following information in your email:
- Your contact information (Name, Address, Phone number, Order number)
- Briefly describe what is damaged
- Photos of damage
- Tracking number

b) Wait for a response or phone call from TankAndBarrel.com and we will provide you with further instructions.

V. Product Descriptions

TankAndBarrel.com attempts to be as accurate as possible. If a product offered by TankAndBarrel.com itself is not as described, your sole remedy is to return it in unused condition.

VI. Pricing

Where an item is offered for sale by one of our merchants, the List Price may be provided by the merchant.

With respect to items sold by TankAndBarrel.com, we cannot confirm the price of an item until you order and despite our best efforts, a small number of the items in our catalog may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Products purchased with a "Pricematch" discount are only valid prior to shipment of the product.

Product & Assembly Safety: TankAndBarrel.com neither designs or manufactures any of the products offered or sold on this site, and as such, makes no representation or guarantee about the safety of these products, or, in the case of self-assembled items, about whether purchasers who receive such products will properly and safely assemble these items. Product and assembly safety is solely and exclusively the province and responsibility of the manufacturer, the purchaser, and the shipper. Any suspected damage in shipping must be noted at the time a shipment is received with the shipper, and as stated above, must be described to TankAndBarrel.com within 24 hours. Assume that suspected damage may create a potential safety hazard and we advise that you do not use the product.

Product assembly must be done exactly in conformance with the Manufacturer's written instructions, and if offered, the Manufacturer's telephone assistance.

Disclaimer of Unstated Warranties. THE WARRANTIES ADVERTISED ON THIS WEBSITE ARE THE ONLY WARRANTIES APPLICABLE TO THIS PURCHASE. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED.

Limitation of Liability. IT IS UNDERSTOOD AND AGREED THAT SELLER'S LIABILITY WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, IN NEGLIGENCE OR OTHERWISE SHALL NOT EXCEED THE RETURN OF THE AMOUNT OF THE PURCHASE PRICE PAID BY PURCHASER AND UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES. Forum Selection Clause. IX. California Proposition 65

Proposition 65, officially the Safe Drinking Water and Toxic Enforcement Act of 1986, is a law that requires warnings be provided to California consumers when they will be exposed to chemicals identified by California as causing cancer or reproductive toxicity. The warnings are intended to help California consumers make informed decisions about their exposures to these chemicals from the products they use. The California Office of Environmental Health Hazard Assessment (OEHHA) administers the Proposition 65 program and publishes the listed chemicals, which includes more than 850 chemicals. In August 2016, OEHHA adopted new regulations, effective on August 30, 2018, which change the information required in Proposition 65 warnings. Any products that have been identified by the manufacturer as exceeding the chemical threshold as defined in Proposition 65 are denoted by this symbol and associated warning text in the product description.

X. Sales & Use Tax

TankAndBarrel.com maintains sales and use tax compliance with all states within the United States.

Arizona (AZ), California (CA), Colorado (CO), Florida (FL), Illinois (IL), Georgia (GA), Kentucky (KY), Maryland (MD), Michigan (MI), Missouri (MO), North Carolina (NC), Ohio (OH), Pennsylvania (PA), Tennessee (TN), Texas (TX), Washington (WA) and Wisconsin (WI) Residents: TankAndBarrel.com is required to collect and remit City, State and Local sales tax for all purchases where our products are shipped to the states of AZ, CA, CO, FL, GA, IL, KY, MD, MI, MO, NC, OH, PA, TN, TX, WA and WI unless otherwise exempt.

Oklahoma (OK) Residents: TankAndBarrel.com is not required to collect and remit sales tax for products shipped to the state of Oklahoma. We are required to notify Oklahoma residents that use tax is imposed and must be paid by the purchaser, unless otherwise exempt, on items brought into Oklahoma for use or consumption.

Sales tax is not required to be collected or remitted for all other states not listed above until physical or economic nexus requirements are met.
